Scope of this Policy
By using the Service, registering your details or participating in the Service, you consent to Online Octane handling and processing your information as described below.
Third party information and websites
Information may be sourced from third parties by Online Octane and/or you in compiling the Service. Where such third party information forms or may form part of the Service, we have relied on the information provided to us by third parties. We do not guarantee the correctness or completeness of the information provided on the Service.
Who processes Personal Information?
Where Personal Information is collected from you in connection with your use of the Service or where you consent to the use of your Personal Information, Online Octane is responsible for the processing and storing of such Personal Information.
Personal Information collected in connection with the distribution of products, services and software
To provide the Service, a Subscriber must provide minimal details including a display name to use the Service and an email address. The Service allows Subscribers to submit additional Personal Information to the Service to create a personal profile, post content and share it with other Subscribers.
Storage, security and retention of Personal Information
Personal Information that Online Octane collects is stored on cloud-based servers (which may be located outside the EEA). We implement and maintain adequate security measures to protect such information stored on our servers and seek to comply with all local rules in respect of storage of data. Online Octane also seeks to collect no more Personal Information from Subscribers than is required for the purpose for which it is collected. This, in turn, helps reduce the total risk of harm should data loss or a breach in security occur.
When you use the Website
URL, internet protocol and website usage information
When you use the Service your IP address is recorded to guard against possible abuses. This information is not used by us to track your movement outside the Service. We may also collect information about users of the website through on-line surveys and questionnaires, preference choices you make and information on your usage of the Service. Users traffic patterns (such as which website you have come from and which website you go to from the Service) may be tracked throughout your online session. We use your IP address to diagnose problems with and administer the Service and to gather demographic information, and to help prevent abuse or fraudulent use of the Service or your account.
When you contribute content to the Service
Contributing content or posts to the Service (“Contributions”) includes your participation in discussions and your submission of articles, photos and videos to Service.
As a Subscriber, you may participate in any discussions, articles or communication spaces offered on the Service. The Contribution will be made public (available to be viewed by any other Subscriber). Any Contribution viewable by other Subscribers may be shared via a number of social media platforms (including, without limitation, Facebook, Twitter, Google+) and email. When a Contribution is shared in this way a link to that Contribution is sent out via the relevant social media channel.
Communication with other Subscribers
Other forms in which Personal Information may be used
There may be limited circumstances in which Online Octane is obliged to disclose Personal Information to unrelated third parties such as:
- In response to the following: (1) to satisfy a legitimate government request or direction or in response to a court order or in connection with legal proceedings; (2) in response to a third-party subpoena, if on legal advice such response is required; or (3) if necessary to defend Online Octane, or its partners or other Subscribers (for example, in a lawsuit).
- If you request a specific service or product which is administered by a third party who is working with Online Octane, your Personal Information may be shared with such third party in order to respond to the request. The third party in question may also transmit back to Online Octane any new information obtained from you.
- Online Octane will fully co-operate with law enforcement, investigation and security agencies and regulators to identify anyone who uses the Service or software for illegal activities. Online Octane reserves the right to report to law enforcement, investigation and security agencies and to regulators any activities that are believed to be unlawful.
Personal Information collected by Online Octane may be processed by Online Octane’s partners when providing services to Online Octane (such as administration and technical services, hosting services, data migration services and analytical services). Online Octane ensures that such partners do not use Personal Information for any other purposes, that they do not disclose it to third parties and do not retain copies except as necessary to provide services to Online Octane or as required by law.
Other third parties that may have access to Personal Information
Notification in the event of breach
In the unlikely event of a breach in the security of Personal Information, Online Octane may decide to notify any Subscriber affected. Online Octane may give notice via in-product messaging systems, email (if possible), publication on Online Octane’s website or on the product portals. Subject to legal and regulatory requirements, Online Octane reserves the right to decide whether or not to give notice of a data breach to Subscribers, and which Subscribers should be notified, and may delay notification if it is asked to do so by law enforcement or other authorities, or if Online Octane believes that giving notice will increase the risk of harm to its Subscribers.
Online Octane does not seek to collect “sensitive” Personal Information such as sexual preference, religion, political views, or health. Online Octane does not wish to receive any such data and will not request it. If Subscribers voluntarily post such information on the Service or share it with other Subscribers, the Subscriber assumes the risk of such information being accessed, used or distributed by others with whom the information was shared.
Data on children
Persons under the age of 16 should not transfer Personal Information to us unless they have the consent of their parent(s) or guardian(s). We do not knowingly collect, nor do we want to receive, Personal Information about individuals who are under 13 years of age.
Contacting Online Octane about privacy questions or concerns
If you contact Online Octane by e-mail or letter, we may keep a record of your correspondence or comments. We may ask for your name, e-mail address and contact information in order to send you a reply.
Changes to your Personal Information and unsubscribing from the Service
You may change the Personal Information that Online Octane retains about you by accessing the Service and following the instructions. Whenever you update, amend or change your Personal Information, Online Octane will automatically update your details on the Service. Where you have shared any information with a third party when using the Service and you wish to update such information, you are responsible for notifying the relevant third party of such updates.
You may unsubscribe from the Service at any time. When you unsubscribe from the Service (or when it is otherwise terminated) we will permanently and irretrievably delete all Personal Information we hold on your behalf, save that:
(1) copies of your Personal Information may remain stored for limited periods of time on back-up media which shall be cleansed from time to time;
(2) if you have elected to share your details with other Subscribers and third party websites, some of your details (your name and email address), as current immediately before you left the Service, will continue to remain available to such Subscribers on their devices or websites and under their sole control;
- Online Octane shall be entitled to retain any data in Generic Data obtained from your Personal Information.
Deleting your account
If you want to delete your account you should send an email to Support. When your account is deleted all Personal Information will be removed from the visible areas of the Service, however, we will continue to store your personal information for administrative purposes for a period of time. Deleting your account will mean you can no longer log in to the Service, but your Contributions will remain available to view on the Service in anonymised form. We do this for the consistency of the website and to ensure other Subscribers continue to have the experience they expect.
